HRIA submitted a communication according to the special mechanisms to Christoph Heinz, the Special Rapporteur on extrajudicial, summary or arbitrary executions, Michael Link, the Special Rapporteur on the situation of human rights in the Occupied Palestinian Territories, and Najat Maalla, Special Representative of the Secretary-General on Violence against Children in which it called for an international and independent investigation under the auspices of the Human Rights Council into the murder of the Palestinian child Ali Ayman Abu Alya, 14, in particular, and the executions and serious harming of other Palestinian children. The Association called them also to not allow the perpetrators to go unpunished by relying on the fake investigations which carried out by the Israeli occupation to deceive the international community.
HRIA said that since the beginning of the Palestinian-Israeli conflict, the Palestinian children have been the victims of any confrontation or conflict in which the Israeli occupation authorities are a party. For example, the three military operations launched by the Israeli occupation on the Gaza Strip. In the 2008/2009 aggression, the occupation authorities killed 318 children. In the 2012 aggression, it killed 32 children. In 2014, it killed 530 children. As for the Marches of Return that broke out in March 2018 and continued until November 2019, the occupation authorities killed 62 children.
HRIA indicated that the occupation authorities also applied this systematic behavior in confrontations and protests in the West Bank. The occupation authorities seek to mislead international justice and absorb the anger of international public opinion by announcing the opening of investigations into the killings and violations against children, and then closing them again, which confirming that they are fake investigations. The last of these fake investigations was the investigation of the shooting in the head of the child Malik Issa, 8, from occupied Jerusalem on February 15, 2020, which later resulted in the removal of his left eye. To absorb the international reaction, the occupation authorities announced an investigation into the incident, but on December 3, the Israeli police closed the investigation file.
HRIA clarified the details of the crime in which the occupation soldiers killed the child Ali Ayman Abu Alia, 14, after he was shot in the stomach during the occupation authorities’ suppression of the demonstrations and protests that took place near the eastern entrance to the village of Mughayir, northeast of Ramallah. Four other young men were injured in the protests. The child Abu Olaya was taken to the hospital, where he died after a few hours.
HRIA said that the Israeli occupation authorities target the right of Palestinian children to life and work to execute them or inflict physical disability on them by targeting sensitive and lethal places in their bodies with live bullets and lethal tools. In addition, the occupation authorities guarantee their criminals legal and political protection and seek to enable them to escape punishment and accountability through deceptive investigations.
HRIA stressed that it is the responsibility of the Special Procedures, the Human Rights Council and the international accountability mechanisms to investigate these violations and to make the necessary recommendations that lead to hold the perpetrators accountable and to ensure reparation in accordance with the standards and rules of international law.
